1. Controller

The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is:

Fahrschule Rausch
Owner: Patrik Rausch
Ungererstr. 118a
80805 München (Munich), Germany
Phone: +49 89 365808
Email: info@fahrschule-rausch.de

For questions about data protection and to exercise your rights, please contact us using the details above. We have not appointed a data protection officer, as we are not legally required to do so.

The Neuhausen location (Nymphenburger Str. 190, Munich) is a legally independent business (owner: Guido Karrasch) with its own contract terms. If you choose Neuhausen when registering or booking an appointment, we pass your details on to the Neuhausen location, which is itself responsible for any further processing (contact: nymphenburgerstrasse@fahrschule-rausch.de, phone +49 89 12111093).

2. Key points at a glance

  • This website sets no cookies and uses no analytics or tracking services (e.g. no Google Analytics), no advertising networks and no social media plugins.
  • Fonts, images and scripts are loaded from our own web server. The only exception is online appointment booking (see “Online appointment booking”).
  • We use the data you give us via online registration, appointment booking, email or the AI chat only to handle your request and carry out your training. We never sell data.
  • The AI assistant in the chat is an artificial intelligence, not a human. To improve the chat, we store questions and answers without your IP address for 3 months.

3. Hosting and server log files

Our website is operated by an external hosting provider (net-n-net), which processes data on our behalf (Art. 28 GDPR). Each time you open a page, your browser automatically sends technical information to the web server, which is stored in server log files:

  • IP address of the requesting device
  • date and time of access
  • page or file requested and amount of data transferred
  • HTTP status code (e.g. whether the request was successful)
  • website you came from (referrer)
  • browser and operating system

Purpose: this data is technically necessary to display the website and to ensure its stability and security (e.g. to fend off attacks). The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is the secure and error-free operation of the website.

Log files are stored until the end of the calendar month following the access and then deleted, unless they are needed in an individual case to investigate a security incident or to pursue legal claims. They are not combined with other data sources.

The connection to our website is encrypted via TLS/SSL (recognisable by “https://” and the padlock icon in your browser).

4. Contact by email and phone

If you contact us by email or phone, we process your details (e.g. name, email address, phone number and the content of your request) in order to answer you. The legal basis is Art. 6(1)(b) GDPR where your request relates to training or a contract, otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries).

Our emails are stored by STRATO AG, Berlin, as a processor. To answer faster, email enquiries may be handled with the support of an AI system (see “Use of AI systems”).

We delete your request once it has been dealt with, unless statutory retention obligations (e.g. for business correspondence) apply.

5. Online registration for training

You can register for training or a Driver Improvement Seminar (ASF) using our online registration form. We process:

  • surname, all first names and date of birth
  • home address (street, house number, postcode)
  • email address and mobile number
  • email address of a parent or guardian (minors only)
  • email address of the person paying the costs
  • details of any existing driving licence (classes, issuing country, date of issue)
  • desired training or class, preferred location and any voluntary message to us

Purpose: handling your registration, concluding and performing the training contract, organising lessons, driving lessons and exams, invoicing and communicating with you (and, for minors, with the parents or guardians or the person paying the costs). The legal basis is Art. 6(1)(b) GDPR (contract and pre-contractual measures) and Art. 6(1)(c) GDPR where we are legally required to keep records (e.g. under the German Driving Instructors Act and tax law).

We need the mandatory fields marked * for registration and the contract. Without this information we cannot process your registration.

Recipients

  • the driving licence authority (e.g. Kreisverwaltungsreferat München) and the technical testing body (TÜV SÜD), where necessary for your application and exams
  • our driving school management software (Fahrschulmanager) and our email provider as processors
  • the learning app “FAHREN LERNEN”, if we set up access for you
  • for the Neuhausen location, the independent business operating it (see “Controller”)

Storage period

We store your data for the duration of your training and afterwards for as long as statutory retention obligations apply (in particular under the Driving Instructors Act and commercial and tax law, generally up to ten years for accounting records). If no contract is concluded, we delete your registration data as soon as it is no longer needed.

6. Online appointment booking

On our page “Book a consultation appointment” you can book an appointment (e.g. consultation and registration or a Driver Improvement Seminar). We process the appointment type, vehicle, location and time slot you choose as well as your first name, surname, email address, phone number and any optional wishes. The purpose is to allocate and confirm the appointment and to contact you about it if needed. The legal basis is Art. 6(1)(b) GDPR. The data is deleted once the appointment has taken place and no training results from it, at the latest when statutory retention periods expire.

To display the booking calendar, the software library “FullCalendar” is loaded from the content delivery network jsDelivr (cdn.jsdelivr.net). For technical reasons, your IP address is transmitted to the operator of jsDelivr or its network partners; processing outside the EU (e.g. in the USA) cannot be ruled out. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is a reliable and fast display of the booking calendar. The content of your booking is not transmitted to jsDelivr.

7. Use of AI systems

AI assistant in the chat

On our website you can ask questions to an AI assistant (button “Questions? AI assistant helps instantly”). The assistant is an artificial intelligence, not a human. It answers questions based on the content of this website. Its answers may contain errors and are not binding; our contracts, price lists and the information given by our staff are binding.

When you use the chat, your messages and the conversation so far are sent via a relay service at Cloudflare, Inc. (San Francisco, USA) to the AI model Claude by Anthropic PBC (San Francisco, USA), processed there into an answer and sent back to your browser. For technical reasons Cloudflare also processes your IP address; we only use it briefly to prevent misuse through too many requests (in working memory for no more than 10 minutes).

To improve the chat, we store each question together with the assistant’s answer, the time, the language and the page on which the chat was used. So that we can tell which questions belong to one conversation, each conversation receives a random identifier that does not allow any conclusions about you. Your IP address is not stored. Phone numbers, email addresses and account numbers are automatically masked before storage. The entries are kept in a database at Cloudflare located in the EU and are deleted automatically after 3 months. We analyse them to improve the answers and to add missing information to our website. The conversation in your browser is kept only in session storage (sessionStorage) and is deleted when you close the browser window or click “New chat”. Under its contract terms, Anthropic does not use the content to train its AI models and stores it only for a limited period, e.g. to detect misuse.

Please do not enter personal data such as your date of birth, address, ID or bank account numbers, or any health data in the chat; the chat also points this out when you first open it. For personal matters, please contact your location directly.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in answering questions quickly and around the clock) or Art. 6(1)(b) GDPR where your question prepares training with us. Storing the chat to improve it is based on Art. 6(1)(f) GDPR (legitimate interest in correct and complete answers); you can object at any time (see “Right to object”). Using the chat is voluntary; you can always reach us by email or phone as well.

AI support for emails and administration

We also use the AI system Claude by Anthropic to handle email enquiries, to transfer online registrations into our management software and for organisational processes. The data required in each case (e.g. name, contact details, content of the request, training and appointment data) may be processed. The legal basis is Art. 6(1)(b) GDPR or Art. 6(1)(f) GDPR (legitimate interest in efficient processing).

Automated handling of Driving Appointment requests

Requests for driving lessons that you submit via our app are handled with the help of an AI-based system (Claude by Anthropic). Based on the credit balance stored with us and our scheduling rules, it automatically checks whether a requested Driving Appointment can be confirmed. For this purpose we process your name, contact details, account balance or credit and the appointment data. The legal basis is Art. 6(1)(b) GDPR.

Insofar as this constitutes an automated individual decision within the meaning of Art. 22 GDPR, you have the right to obtain human review, to express your point of view and to contest the decision. Please contact Patrik Rausch, info@fahrschule-rausch.de.

Transfers to the USA

We have data processing agreements with Anthropic and Cloudflare pursuant to Art. 28 GDPR. Transfers to the USA are based on the European Commission’s adequacy decision for the EU-US Data Privacy Framework where the provider is certified under it, and otherwise on the EU Standard Contractual Clauses (Art. 46(2)(c) GDPR).

8. Browser storage (no cookies)

Some features of our website store data only in your own browser. This data is not transmitted to us:

  • Class finder: stores your answers in local storage (localStorage) so that your result is still there on your next visit. You can remove this data at any time in your browser settings (“Clear site data”).
  • AI chat: stores the conversation, the random conversation identifier, whether you have confirmed the notice about the AI service and whether the welcome hint has already been shown in session storage (sessionStorage). This data is deleted automatically when you close the browser window.
  • Cost calculator and time planner: calculate only in your browser; your entries are not transmitted to us.

The legal basis for storing and reading this data is Section 25(2) No. 2 of the German TDDDG, as it is strictly necessary for the feature you have expressly requested; any further processing is based on Art. 6(1)(f) GDPR.

Our website contains links to other providers, e.g. Google Maps (directions to our locations), Apple’s App Store, Google Play, the website of the FAHREN LERNEN app, TÜV SÜD and public authorities. This content is not embedded in our pages: only when you click such a link are you taken to the provider’s site, which is then responsible for data processing.

The Google reviews shown on our website have been copied as text. No data is transmitted to Google when they are displayed.

10. Recipients and processors at a glance

We only pass on your data where this is necessary to perform the contract or handle your request, where we are legally obliged to do so, or where a service provider processes the data on our behalf and according to our instructions:

  • Website hosting: net-n-net (web server, server log files, forms)
  • Email: STRATO AG, Berlin
  • Driving school management and scheduling: Fahrschulmanager
  • AI systems: Anthropic PBC, USA (via Cloudflare, Inc., USA, for the website chat)
  • Appointment booking: jsDelivr (delivery of the calendar software)
  • Authorities and testing body: driving licence authority, TÜV SÜD
  • Tax adviser, where necessary for accounting and taxes

11. Your rights

You have the following rights regarding your personal data:

  • access (Art. 15 GDPR)
  • rectification of inaccurate data (Art. 16 GDPR)
  • erasure (Art. 17 GDPR)
  • restriction of processing (Art. 18 GDPR)
  • data portability (Art. 20 GDPR)
  • withdrawal of consent with effect for the future (Art. 7(3) GDPR)

Simply contact us at info@fahrschule-rausch.de or at our postal address.

Right to object under Art. 21 GDPR

Where we process your data on the basis of a legitimate interest (Art. 6(1)(f) GDPR), you may object to this processing at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.

12. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your data infringes data protection law. The authority responsible for us is:

Bayerisches Landesamt für Datenschutzaufsicht (BayLDA)
Promenade 18
91522 Ansbach, Germany

What Our Students Say

⭐⭐⭐⭐⭐

Besonderer Dank geht an meinen Motorrad Fahrlehrer Andy.
